Dealer Terms

Effective from 24 October 2026 · Version 2026-10-24

In short: your dealer account is reviewed and approved by us before you can list. You are the seller in every deal: you must have the right to sell each car, describe it honestly, disclose loans and accidents, handle payment, paperwork and RC transfer, and look after your buyers. Use buyer phone numbers only to reply to their inquiry. We can remove listings or suspend accounts that break these rules. This summary is for convenience; the full Dealer Terms below are what apply.

1. Scope

These Dealer Terms apply to every dealership or individual that registers as a dealer on CarNearU (a “Dealer”, “you”). They are in addition to our Terms of Use and Privacy Policy, which also apply to you. If these Dealer Terms conflict with the Terms of Use on a dealer matter, these Dealer Terms prevail. Capitalised words not defined here have the meaning given in the Terms of Use.

2. Registration, review and approval

  • You must provide true, complete and current information about yourself and your business (including your name, dealership name, contact number and, when asked, documents such as GST registration, trade licence or identity proof), and keep it up to date.
  • Every new dealer account is reviewed by CarNearU. You can list vehicles only after your account is approved. We may approve, reject, suspend or close any dealer account at our discretion, including if we cannot verify your details.
  • Approval only means you completed our onboarding checks. It is not an endorsement, certification or guarantee of you, your vehicles or your services, and you must not represent it as one.
  • These Dealer Terms apply equally to every Dealer, including Fast & Furious Cars and any other dealer related to the operator of CarNearU. A related dealer is a separate seller, gets no special treatment, and is solely responsible for its own vehicles and deals.
  • You act for yourself only. You are not an agent, partner, franchisee or employee of CarNearU, and must not tell Buyers otherwise or use CarNearU’s name to make promises on its behalf.
  • You are responsible for everything done through your dealer account, including by your staff.

3. What you promise about every listing

Each time you list a vehicle, you represent and warrant that:

  • you own the vehicle, or are authorised in writing by its registered owner to sell or rent it, and are legally entitled to do so;
  • the vehicle is not stolen, is not the subject of any police case, and its registration certificate, chassis and engine numbers and other documents are genuine and untampered;
  • any loan, hypothecation, lien, pending challan, accident, flood or major repair history is disclosed in the listing;
  • the price, kilometres driven, year, number of owners, fuel, variant, condition and photos are accurate and are of the actual vehicle on offer;
  • the vehicle is available — you will mark it sold, rented or inactive promptly, and not keep unavailable vehicles listed to attract inquiries; and
  • the listing complies with all applicable laws, including the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020 and the Motor Vehicles Act, 1988.

4. Your obligations to buyers

  • You are the seller (or lessor) in every deal you make through a CarNearU listing. You alone are responsible to the Buyer for the vehicle, its condition and documents, the price and any payment, delivery, refunds, cancellations, warranties and after-sales service.
  • You will honour the price and terms you advertise, or clearly tell the Buyer before they commit if anything has changed.
  • You will complete, or help the Buyer complete, the transfer of registration (Forms 29 and 30), insurance and any loan closure or NOC within the time required by law, and give the Buyer proper invoices or receipts.
  • You will comply with all laws that apply to your business, including tax and GST, trade certificate and dealer requirements under the Motor Vehicles Act and rules made under it, and consumer protection law.
  • You will deal with Buyer complaints about your vehicles and services yourself, promptly and in good faith.

5. Buyer contact details (leads)

When a Buyer contacts you through the Platform, we share their name and phone number with you. You may use these details only to respond to that Buyer’s inquiry about your vehicle. You must not sell, rent or share them, add them to marketing lists without the Buyer’s consent, spam or harass them, or use them for any other purpose.

For the personal data you receive and use for your own business, you are responsible for complying with the Digital Personal Data Protection Act, 2023, including keeping it secure and deleting it when no longer needed.

6. Listing content and our moderation rights

You grant CarNearU the content licence described in the Terms of Use for all photos, videos and descriptions you upload, and confirm you own them or have permission to use them. We may resize, crop, compress, watermark, reorder or reformat your content for display.

We may hide, edit (for format or to remove prohibited information) or remove any listing, and limit the number of listings you can publish, without liability — for example, if a listing appears inaccurate, duplicated, unlawful or in breach of these Dealer Terms, or on receiving a complaint.

7. Fees

Listing on CarNearU is currently free. If we introduce paid features or fees, we will tell you in advance and they will apply only once you accept them. CarNearU does not charge any commission on, or take any part in, the payment for a vehicle.

8. Indemnity and liability

You agree to indemnify and hold harmless CarNearU, its operator and anyone working for it from and against all claims, complaints, proceedings, penalties, losses, costs and expenses (including reasonable legal fees) brought by any Buyer, authority or other third party that arise out of or relate to your vehicles, listings, deals, communications with Buyers, use of Buyer data, breach of these Dealer Terms or the Terms of Use, or breach of any law.

The limitation of liability in the Terms of Use applies to you. In addition, CarNearU is not liable to you for any loss of business, leads, sales or profit arising from the suspension of your account, the removal of listings, or any interruption of the Platform.

9. Suspension and termination

  • We may suspend or terminate your dealer account, and take down all your listings, at any time if we reasonably believe you have breached these Dealer Terms, the Terms of Use or the law, if Buyers repeatedly complain about you, or if we are required to by an authority.
  • You may close your account at any time by contacting us. Closing your account does not end your responsibility for deals you have already made.
  • If we find or reasonably suspect fraud — for example a fake or stolen vehicle, forged documents, taking money without delivering, or hiding a loan or accident — we may block your account immediately, remove all your listings, keep the related records, and report the matter to and cooperate with the police and other authorities. You remain fully liable to the Buyer and to CarNearU for any loss your fraud causes.
  • Sections on warranties, obligations to buyers, buyer data, indemnity and liability survive termination.
